JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1887 of 2017, disclosing offence under Section 498A of the Indian Penal Code. Petitioner happens to be the husband of the complainant. There is allegation of demand and torture. Submission of the learned counsel for the petitioner is that as a matter of fact, complainant is not ready to reside with the petitioner, as she has love affair with another boy. During the hearing of the anticipatory bail application before the learned Sessions Judge, both were directed to live together, but the complainant did not chose to reside together that complainant

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, East Muzaffarpur, in connection with Complaint Case No. 1887 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
