JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-02-2023 The present petition has been filed for restoration of writ petition bearing C.W.J.C. No. 20502 of 2021, which had stood dismissed on account of non-prosecution by an order dated 05.12.2022.

The learned counsel for the petitioner has submitted that on account of unavoidable circumstances, he could not appear when the case was called out for hearing, hence, the aforesaid writ petition was dismissed for default.

The learned counsel appearing for the respondents has got no objection, in case the aforesaid writ petition is restored.

Having regard to the facts and circumstances of the case and considering the

Patna High Court MJC No.2676 of 2022(2) dt.27-02-2023 2/2 submissions made by the learned counsel for the parties, I deem it fit and proper to restore the aforesaid writ petition bearing C.W.J.C. No. 20502 of 2021, to its original file.
