JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. One country made katta and two live cartridges are said to have been recovered from conscious possession of the petitioner for which the petitioner is in jail custody since 25.3.2018. Although the petitioner does have criminal antecedent which is evident from perusal of para 3 of the petition but it is obvious that prior to institution of the present case, no case for the offences of the Arms Act was lodged against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/-

Patna High Court Cr.Misc. No.43456 of 2018 (2) dt.19-07-2018 with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Kotwali (Basudeopur) P.S. Case no. 101/2018.
