2. The petitioner seeks regular bail in connection with Sabour (Goradih) P.S. Case No. 84 of 2024, lodged on 01.03.2024, under Section 302 of the Indian Penal Code.

3. As per the prosecution, the allegation against the petitioner is that he assaulted his younger brother and killed him by repeatedly attacking him on the chest and stomach.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. It is further submitted that the charge has already been framed in the present case, and no purpose will be served by keeping the petitioner in custody. The petitioner has been in custody since 07.03.2024, and the trial is being unnecessarily delayed.

5. Learned APP for the State opposes the prayer for bail and submits that there is a direct and specific allegation of assault against the petitioner. It is further submitted that although the charge has been framed, the prosecution witnesses have not been examined till date.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected. However, it is directed to the Trial Court to expedite the trial.
