2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 25(1-b)a and 26 of the Arms Act.
3. The case of the prosecution in short is that from the possession of this petitioner one country made pistol and four live cartridges were recovered.
4. Learned counsel for the petitioner has submitted that the petitioner is quite innocent and has committed no offence. Learned counsel has further submitted that the police has forcibly taken the signature of the petitioner on seizure list. Learned counsel has also submitted that the petitioner is in custody since 12.02.2025.
5. Learned Additional Public Prosecutor for the State
Patna High Court CR. MISC. No.76490 of 2025(2) dt.19-11-2025 2/2 has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of six cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with a condition that the petitioner shall co-operate in the trial and shall present himself in the trial court on each and every date till the conclusion of the trial. The above named petitioner is directed to be released on bail in connection with Madhusudanpur P.S. Case No. 19 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur.
