The petitioner has been in custody since 14.04.2018 in connection with Patepur P.S. Case No. 56 of 2018 registered for the offences punishable under Section 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has been named in the First Information Report on the basis of confessional statement made before the police by one Sikandar Kumar Sahani who had accepted that he had purchased one stolen motorcycle from Jitendra Choudhary and had also named the present petitioner. Neither recovery was made from the petitioner nor can he be implicated on the basis of confessional
Patna High Court Cr.Misc. No.42599 of 2018 (2) dt.19-07-2018 2/2 statement made before the police which has no evidentiary value. It is further submitted that the petitioner is having a clean antecedent.
In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Xth, Vaishali at Hajipur in connection with Patepur P.S. Case No. 56 of 2018.
