JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 This is an application for grant of anticipatory bail in connection with Mahila P.S. Case No. 28 of 2019, disclosing offences punishable under Sections 498(A), 323, 504/34 of the Indian Penal Code.
Petitioner happens to be the husband of the informant, there is allegation against him of demand of Rs. 2 lakh and for that assaulted the wife and ousted from the house. Submission of learned counsel for the petitioner is that earlier also a case has been lodged against the petitioner. He is on bail in that case. He further submits he is ready to keep his wife with dignity and care and the allegation is false and concocted.
Heard learned A.P.P. also, from perusal of material available on record it appears that earlier he has been granted
Patna High Court CR. MISC. No.73275 of 2019(3) dt.10-12-2019 2/2 bail in earlier case on the basis of compromise. Having heard both sides, considering the above submission and in view of the stand of the petitioner that he is still ready to keep his wife with dignity and care, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below withing six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Katihar, in connection with Mahila P.S. Case No. 28 of 2019, subject to the condition laid down under Section 438(2) of the Cr.P.C. with condition to co-operate in disposal of the complaint case. (Vinod Kumar Sinha, J) Rahul Mishra/- U T
