ANJANA MISHRA ORAL ORDER 18-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 14.08.2019 in connection with Excise Complaint Case No. 100 of 2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that save and except the confessional statement made before the police which has no evidentiary value, there is no case against the petitioner. The alleged recoveries were not from his conscious possession, but from the boogie of the passenger train in which he was travelling.

Considering the aforementioned facts and circumstances and the petitioner has a clean antecedent, let the petitioner above named be released on bail, on furnishing bail
