The petitioner is in custody since 02.05.2018 in connection with Simari P.S. Case No. 53 of 2018 for the offence registered under Sections 392, 394, 411, 414 and 34 of the Indian Penal Code..

Learned counsel for the petitioner submits that though the petitioner has been named in the first information report, the bolero vehicle was recovered from others and not from the present petitioner. It is further submitted that the petitioner along with three others had gone to pull out the bolero vehicle which had fallen in a ditch and when they were in the process, the petitioner was apprehended and was sent to jail. It is further submitted that

Patna High Court Cr.Misc. No.45961 of 2018 (2) dt.14-08-2018 similarly situated co-accused persons have since been extended the privilege of bail in Cr . Misc. No. 42856 of 2018 vide order dated 19.07.2018 and also in Cr. Misc. NO. 43242 of 2018 vide order dated 26.07.2018.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with G.R. No. 1196 of 2018 arising out of Simari P.S. Case No. 53 of 2018.
