ANJANA MISHRA ORAL ORDER 29-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.06.2018 in connection with Suryapura P.S. Case No.04 of 2017 registered for the offence under Sections 341, 323, 504, 506, 379 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though the allegation is that the petitioner has fired, which hit the hand of the informant's wife and the injury alleged to have been caused has been found to be grievous, but it was not on account of premeditation nor there was any repetition of firing. It is further submitted that there is a case and counter case

Patna High Court Cr.Misc. No.46188 of 2018 (2) dt.29-08-2018 2/2 between the parties in connection with the disputes relating to property and the petitioner is not having any criminal antecedent. Learned counsel further submits that the petitioner shall co-operate in the further investigation. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Bikramganj, Rohtas, in connection with Suryapura P.S. Case No.04 of 2017.
