Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.

The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 109, 303(2), 352, 351(2) of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that the accused persons, who are his uncle (Mausa), called him and his parents for discussing property issue after the death of his maternal grandmother, accordingly the informant

No.75595 of 2025(4) dt.16-02-2026 2/3 along with his father and mother went to meet them, when Rocky assaulted his father by rod causing injury on head, thereafter Sanjay (petitioner), Ramesh and Binay assaulted by lathi and danda and the accused persons snatched his mother's chain and acted inappropriately.

Learned counsel for the petitioner submits that Binay Yadav and Arun Kumar had approached this Court seeking regular bail by filing Cr. Misc No. 58332 of 2025 and the same came to be allowed by an order dated 16-2-2026. It is next submitted that case of the petitioner is akin to the case of Binay and Arun and thus based on parity, seeks regular bail. It is also submitted that petitioner is in custody since 12.6.2025. 5.

Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposes the prayer for bail of the petitioner, but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that specific allegation of assaulting the father of the informant is against Rocky and the father of the informant suffered only one injury.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees

Patna High Court CR. MISC. No.75595 of 2025(4) dt.16-02-2026 3/3 Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kurtha P.S. Case No. 84 of 2025.
