Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
The FIR of the occurrence of robbery is against unknown.
Submission is that name of the petitioner has surfaced in the confessional statement of co-accusedBalmukund Chauhan @ Ram Lakhan Chouhan, who has already been allowed bail by a Coordinate Bench of this Court vide Annexure-P/2. Some other co-accused have also been allowed bail by different Coordinate Benches of this Court.
Patna High Court Cr.Misc. No.45432 of 2018 (2) dt.02-08-2018 2/2 Considering the facts aforesaid as well as statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Banka (Barahat) Police Station Case No.447 of 2009, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
