2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392, 302 of the Indian Penal Code.

3. It is a case of commission of murder of the informant's brother namely, Ajanish Kumar. The informant alleged that his brother went to Hajipur with four wheeler vehicle bearing Reg. No. BR06PD-6483 but some unknown miscreants killed him and looted his vehicle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The prosecution case lodged against unknown. The name of the petitioner came into light on the statement of a witness Anvir

Patna High Court CR. MISC. No.79844 of 2023(3) dt.09-02-2024 2/2 Kumar vide para 89 of the case diary, in which he stated that he saw the petitioner in perplexed condition with a blood stained knife who stated about murder of the deceased and snatched his vehicle. Except this, no any consistent evidence has come and no any incriminating article has been recovered from conscious possession of the petitioner. It is further submitted that no one is eye witness to the alleged occurrence. The petitioner has got no criminal antecedent is languishing in judicial custody since 26.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail after framing of charge, if not framed in connection with Hajipur Sadar P.S. Case No. 21 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur.
