The petitioner seeks bail in connection with Sessions Trial No. 308 of 2018 arising out of Hilsa P.S. Case No. 340 of 2016, registered for the offence punishable under Section 396 of the Indian Penal Code.

Allegation against the petitioner is of dacoity and committing murder of the father of the informant. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case and there is no recovery from his possession. It has been further submitted that no TIP has been conducted and the name of the petitioner has transpired only on the basis of confessional statement of coaccused Rajesh Kewat. Petitioner is in custody since

Patna High Court Cr.Misc. No.45728 of 2018(2) dt.27-07-2018 2/2 13.04.2018. It has been further submitted that similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 08.05.2018 in Criminal Miscellaneous No. 21308 of 2018 and 20.07.2018 in Criminal Miscellaneous No. 43938 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Hilsa, Nalanda, in connection with Sessions Trial No. 308 of 2018 arising out of Hilsa P.S. Case No. 340 of 2016.
