The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code. As per prosecution case, on 17.10.2019 when the informant who is Credit Branch Manager of Bharat Financial Infusion Ltd. Saraiya Branch, Vaishali, was working in the said Branch suddenly six miscreants armed with pistol entered into branch and on the point of pistol looted away Rs.4,93,259/-, bank vouchers, stationery items and mobile.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case on the basis of suspicion. The petitioner is

Nothing has been recovered from the conscious possession of the petitioner or from his house nor the petitioner has been put on T.I.P. till date. It is also submitted that petitioner is languishing in judicial custody since 25.08.2022. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Vaishali P.S. Case No. 379 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
