The petitioner seeks bail in a case for the offence registered under Sections 341, 323, 504, 506, 307 and 498(A) of the IPC.
The prosecution story, in brief, is that the petitioner who is the husband of the informant, assaulted her with Iron rod on her head causing head injury. When her son and daughter came to rescue her, they were also assaulted by the petitioner with Iron rod.
It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 16.08.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present
Patna High Court CR. MISC. No.67930 of 2019(2) dt.24-10-2019 2/2 case. There is no allegation of tampering with the witnesses alleged against the petitioner. Nature of injury is said to be simple. No offence under Section 307 of the IPC is made out. Rests of the offences are triable by the Magistrate. The petitioner happens to be the husband of the victim. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Vaishali at Hajipur, in connection with Mahila P.S. Case No. 20 of 2019.
