The petitioner has filed the instant application for grant of regular bail in connection with Barachatti P.S. Case No. 733 of 2023 registered under section 379, 411, 420, 467, 468 of the Indian Penal Code.

As per FIR, the petitioner was apprehended on the spot and from his Varandah one stolen motorcycle was recovered.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has no concern with the alleged recovered motorcycle due to high handedness of the police officials he has been made accused in

Patna High Court CR. MISC. No.79634 of 2023(2) dt.11-12-2023 2/2 this case. It is further submitted that Section 100 of the Cr.P.C. has not been followed while preparing the seizure list. Moreover, the petitioner is languishing in judicial custody since 05.08.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Barachatti P.S. Case No. 733 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 2nd, Sherghati, Gaya.
