2. The petitioner is in custody in connection with Taraiya P.S Case No. 398 of 2024 registered for the offences punishable under Sections 137(2), 87 of the BNS.
3. As per allegation in the FIR, petitioner along with other accused person has eloped the daughter of the informant for the purpose of marriage.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the alleged occurrence is on 13.10.2024 and the present FIR has been lodged on 17.10.2024 without any reasonable explanation of inordinate delay. He further submits the petitioner is a young boy and he has not kidnapped or abducted the informant's daughter. He further submits that informant's daughter willingly left her home and went
Patna High Court CR. MISC. No.75032 of 2025(3) dt.18-12-2025 2/2 somewhere for visiting purpose and in the meantime the present FIR was lodged. It is also submitted that petitioner is in judicial custody since 11.08.2025 having clean antecedent.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, Statement of victim under Section 183 of the BNS and and impugned order dated 15.09.2025, it appears that daughter of the informant had went with the petitioner with her own freewill to Delhi and solemnized their marriage. Moreover, they are in love affairs with each other and there is no allegation of sexual assault. So considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-13 at Chapra, Saran in connection with Taraiya P.S. Case No. 398 of 2024 (Ramesh Chand Malviya, J) Sunnykr/- U
