JUSTICE PARTHA SARTHY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 06-12-2024 The writ petition is filed to quash the recommendation made by the Circle Officer, Sahar, Bhojur, who has made a recommendation to the District Panchayat Raj Officer, Bhojpur for construction of a Gram Panchayat Raj Bhawan on a land situated at Mauza-Kanpahari Gram Panchayat- Dhanchhuhan, Circle-Sahar, District- Bhojur. The petitioner's contention seems to be that Gram Panchayat Bhawan should come up at MauzaDhanchhuhan, Gram Panchayat Dhanchhuhan, Circle-Sahar,

2. Admittedly, there is only a recommendation made and there are objections filed before the District Panchayat Raj Officer. Definitely, before the recommendation is accepted, the District Panchayat Raj Officer will consider the objections. We find absolutely no reason to initiate a public interest litigation on the feeble averments made in the writ petition.

3. We reject the writ petition, but, however, make it clear that the Panchayati Raj Officer will consider the objections, and a decision taken in accordance with law and as far as possible, following the guidelines issued; exception being made on valid reasoning.
