The petitioner seeks regular bail in connection with Prosecution Report nO121 of 2019 dated 16.8.2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 200 ltrs. of liquor from a Tempo and the petitioner was arrested from there.

Submission of the learned counsel for the petitioner is that he has been made accused only on suspicion as he was a passenger in the Tempo. He is in custody for about four months. Charge sheet has already been submitted. He has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Special Case No.7350 of 2019 arising out of Prosecution Report No.121 of 2019 with condition to cooperate in the disposal of the trial.. With the aforesaid observation, this application is allowed.
