====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and in the impugned order it has been wrongly recorded that he is in custody since 15.11.2022, when petitioner is in custody since 18.11.2022 as recorded in paragraph 10 of the bail petition. The allegation is of recovery of 156.960 liters of liquor from the house and from the back side of the house of the petitioner.

Learned counsel submits that the house in question is

Patna High Court CR. MISC. No.1423 of 2023(2) dt.04-03-2023 2/2 a joint family property and the petitioner because of his antecedent came to be implicated in the present case. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Derni P.S. Case No. 155 of 2021.
