Petitioner apprehends his arrest in connection with Barun P.S. Case No. 120 of 2018 registered for the offences punishable under Sections 379, 411, 420/34 of the Indian Penal Code and 4/40 B.M. MCR and 15 Environmental Protection Act. Allegation as per F.I.R. is that tractor was found engaged in illegal mining of sand and petitioner's tractor was also intercepted.

Submission of learned counsel for the petitioner is that he is the owner-cum-driver of the tractor and he was only carrying the sand for personal use and not for sale. Heard learned A.P.P. also.

Having heard both sides and in the facts and

No.46381 of 2018 (2) dt.10-08-2018 2/2 circumstances as stated above, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Barun P.S. Case No. 120 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
