2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, on the basis of secret information, the police party raided a place and apprehended three persons along with country-made pistol and live cartridges. One of the co-accused, namely Manoj Kumar, who was apprehended at the spot, disclosed the name of this petitioner as one of the persons who succeeded to flee away from the spot.

4. It is submitted by learned counsel for the petitioner that no incriminating material has been recovered from the petitioner and he has not been apprehended at the spot.

Patna High Court CR. MISC. No.79959 of 2023(2) dt.10-01-2024 2/2 Petitioner has falsely been implicated in this case only on the basis of statement of co-accused Manoj Kumar. Except confessional statement, there is no other material on record to connect the petitioner with the alleged incident. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari, in connection with Pakaridayal P.S. Case No.199 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
