The petitioners seek anticipatory bail in connection with Bathnaha P.S.Case No. 376 of 2017 (G.R. No. 5204 of 2017), registered for offences punishable under Sections 341, 323 and 353/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is that the petitioners along with others forcibly entered into the school premises without taking permission in a Bolero vehicle and with cooperation of one Master Anuj Kumar, student of Class XII started beating one Master Gautam Kumar of Class IX and when a teacher, Dhheeraj Kumar was made protest, they assaulted the teacher.

Submission of the learned counsel for the petitioners is that as a matter of fact Rs. 10,000/- was demanded by the teacher

Patna High Court Cr.Misc. No.40873 of 2018 (3) dt.23-07-2018 2/2 for managing the centre for appearing in examination, which was objected by the son of the petitioner No. 1 and for that he received grievous injury on his head and the petitioners have been falsely implicated in this case the petitioners have no criminal antecedents..

Learned A.P.P. opposes the prayer for.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender before the court below within a period of six weeks from the date of the order, he will be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S.Case No. 376 of 2017 ( G.R. No. 5204 of 2017) subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
