The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code. Later on, Section 411 of I.P.C. has been added.
Allegation is that some unknown persons stolen away the motorcycle of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.4.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come as the motorcycle in question is said to have been recovered from the petitioner. The petitioner had no knowledge that the motorcycle in question is
Patna High Court CR. MISC. No.68194 of 2019(2) dt.18-11-2019 2/2 stolen property. He has been made accused due to mistake of fact.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhabua (Kaimur) in connection with Mohaniya P.S. case No.136 of 2019/G.R. No.558 of 2019.
