JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 32(ii), 34(ii), 38(ii) and 41(i) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that petitioner has antecedent of two cases and is in custody since 01.12.2022.
Allegation is of recovery of 203.016 litres of liquor from the house of the petitioner.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and the house is a joint family property, as such, it cannot be alleged that it was the petitioner who had kept the liquor in the house. It is further submitted that because the criminal antecedent, the

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the submission, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mahua P.S. Case No. 707 of 2019.
