JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks regular bail in connection with Paliganj P. S. Case No.12 of 2018 registered for the offences punishable under Sections 302, 120B, 34 of IPC and Section 27 of the Arms Act.

As per F.I.R. petitioner is one of the assailant, there is allegation of firing against the deceased, causing his death. It further appears that earlier his prayer of bail was rejected, vide order dated 20.11.2018 passed in Criminal Misc. No. 63177 of 2018 with observation to conclude the trial within a period of six months.

Submission of the learned counsel for the petitioner is that he is in custody for more than two and half years and there was observation to conclude the trial within a period of six months.

No.79926 of 2019(3) dt.18-12-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant has opposed the prayer for bail on the ground that case is posted for argument and only because the petitioner is taking time, the session cannot be concluded. Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the disposal of the trial.

With the above observations, this application is dismissed.
