Petitioners are apprehending their arrest in connection with Barauli P.S.Case No.191 of 2019 , registered for offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
As per the FIR, while the informant was putting Nad on the land the petitioner and other accused persons assaulted him. There is specific allegation against one co-accused , Sanjay
Patna High Court CR. MISC. No.68954 of 2019(2) dt.04-11-2019 2/2 Bhaga of assault.
Submission of the learned counsel for the petitioners is that there is land dispute between the parties and there is case and counter case and moreover the injury is said to be simple which will appear from annexures 3 to 5.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM XIV, Gopalganj in connection with Barauli P.S.Case No.191 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
