2. The petitioner apprehends in a case registered for the offence punishable under Sections 379, 414 of the Indian Penal Code and Section 56, 39 (3) of the Bihar Mineral (C.P.T.S.) and amended rule, 2021 in connection with Bidupur P.S. Case No. 464 of 2022

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application with a liberty to file regular bail application in the court below.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.80100 of 2023(2) dt.15-12-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
