2. Petitioner seeks regular bail in connection with Mairwa P. S. Case No. 246 of 2025 in a case registered for the offences punishable under Sections 103(1) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, informant suspects that for money and jewellery her brother had been killed by the petitioner. On 10.06.2025 she had given Rs. 2,00,000/- to her brother and her brother also had Rs. 1.5 lakhs cash and jewellery worth Rs. 5,00,000/- to purchase a piece of land and his brother had kept the cash and jewellery in the almirah of the house and at that time Balmiki Gond (petitioner) was sleeping in the room. Thereafter, a suspicion was raised by the informant

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is no eye witness of the said occurrence and no incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has clean criminal antecedent and he is in custody since 12.06.2025. Charge-sheet has already been submitted.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- V, Siwan/concerned Court below in connection with Mairwa P. S. Case No. 246 of 2025.
