Petitioner, already in custody, seeks bail in connection with Deepnagar P.S. Case No.216 of 2016, registered under Sections 147, 148, 149, 341, 323, 307 and 302 of the Indian Penal Code as well as under Section 27 of the Arms Act. Learned counsel for the petitioner submits that earlier the prayer of bail of the petitioner was refused by this Court vide order dated 16.01.2018, passed in Cr. Misc. No.49482 of 2017 with an observation that if trial is not concluded within six months the liberty being given to him for renewal of the prayer of bail. It is further submitted that there is allegation against two persons, the petitioner and one Ajit Kumar having shot at the deceased but only one firearm injury was found on his person

Patna High Court Cr.Misc. No.45084 of 2018(2) dt.01-08-2018 2/2 and Ajit Kumar was admitted to bail by a co-ordinate Bench of this Court vide order dated 16.05.2018, passed in Cr. Misc. No.22850 of 2018. However, the petitioner has also moved after six months of the earlier rejection as per the observation. Having considered the aforesaid facts and circumstances, petitioner Jitendra Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cumSpecial Judge, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No.216 of 2016, giving rise to Sessions Trial No.450 of 2017.
