JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Didarganj P.S. Case No. 218 of 2019 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

Petitioners happen to be brothers-in-law and sister-inlaw (Gotni) of the deceased and the case is of dowry death. Submission of learned counsel for the petitioners is that there is general and omnibus allegation against them and they have also annexed electricity bill showing that they are residing separately from the husband of the deceased and earlier also there was partition between the parties, Annexure-2, which

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that deceased died due to asphyxia caused by pressure over neck by ligature.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Patna City, in connection with Didarganj P.S. Case No. 218 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioners have to appear before police as and when required and co-operate in the investigation.
