The petitioner seeks regular bail in connection with Akbarpur P.S. Case No. 73 of 2018 for the offences punishable under Sections 394 of the Indian Penal Code.
The allegation in the present case is regarding unknown accused persons having apprehended the Truck Driver i.e. the petitioner herein and the Khalasi of the truck and thereafter had taken away the truck.
The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and he being a driver has got no role to play in the alleged crime since he himself had informed the owner of the truck about theft of the truck. It is submitted that the petitioner is languishing in
Patna High Court Cr.Misc. No.33656 of 2018 (3) dt.25-07-2018 2/2 custody since 23.03.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 73 of 2018.
