Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner, already in custody, seeks bail in connection with Hathua P.S. Case No.15 of 2018, registered under Sections 147, 148, 149, 323, 324, 325, 307, 371 and 504/34 of the Indian Penal Code.

Accusation against the petitioner is that on account of land dispute, accused persons assaulted the informant and the petitioner is alleged to be armed with spear and said to have given one blow over the head.

Learned counsel for the petitioner submits that the

No.46947 of 2018(2) dt.01-08-2018 2/2 allegation is that the petitioner was armed with spear but accusation is of giving farsa blow and that is a single blow but injury is simple in nature, besides this there is land dispute between both sides and case and counter case in between them; whereas the learned counsel for the informant opposes the prayer of bail.

Having considered the aforesaid facts and circumstances in particular the nature of injury, petitioner Birbahadur Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-14, Gopalganj in connection with Hathua P.S.
