1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 15.09.2023 at 08:00 PM, he was coming back home after closing the shop on his motorcycle, when he was intercepted by two unknown accused who on point of gun and knife looted his motorcycle and other articles as detailed in the FIR, thereafter the informant called the police and took the police in the direction, the accused had fled, when he saw one of the accused coming from that side on a motorcycle, but seeing

4. Learned counsel for the petitioner submits that petitioner was not arrested from the spot. It is next submitted that his name transpired in the case based on the fact that the motorcycle was registered in his name. It is also submitted that petitioner was not present on the date of occurrence rather he stays in Calcutta where he works as a cook for his livelihood. It is also submitted that son of the petitioner was using his motorcycle, but since the motorcycle was registered in the name of the petitioner, as such, he came to be implicated. It is also submitted that a supplementary affidavit has been filed wherein it has been specifically pleaded at Para-2 that petitioner for the last 15-20 years is residing at 29, Sarat Boss Road, L. R. Sarani, Circus Avenue, Kolkata, West Bengal 700020 and his Aadhaar No.
is 880263432222 and Health Card No. is 19071611026557691, as would manifest from Annexure P/2 to the supplementary affidavit. It is also pleaded at Para-3 that petitioner is working as cook in the office of Ranjit & Company for the last 15 years and the addressed mentioned on his Aaadhar card and Health Card is office address of Ranjit & Company.
Patna High Court CR. MISC. No.74456 of 2025(3) dt.19-02-2026 3/3 rather will cooperate in the investigation to prove his innocence.
5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the pleadings made in the supplementary affidavit, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Muffasil P.S. Case No. 392 of 2023 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. Accordingly, the instant anticipatory bail application is allowed.
