JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Chanpatia P.S. Case No. 260 of 2019, registered for the offences punishable under Sections 420, 467, 468, 471, 504, 506, 34 of the Indian Penal Code. As per F.I.R. petitioner is said to have got sale deed registered in the name of the petitioner No.1 and further petitioner No. 1 executed a deed in favour of petitioner No.2 deprived the share of the husband of the informant. Submission of the learned counsel for the petitioners is that informant is the Bhabhi of the petitioners and as a matter of fact, petitioners No. 1 and 2 are brothers and petitioner No. 1 has executed a sale deed in favour of petitioner No.2 and also
Patna High Court CR. MISC. No.68614 of 2019(2) dt.25-10-2019 2/2 the son of the informant and on that time she has not raised any objection. Now she has filed this case. Moreover the case is civil disputes.

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned Learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia P.S. Case No.-260 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
