JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Baghaila P. S. Case No. 22 of 2018, disclosing offences under Sections 363 and 365 of IPC.

As per F.I.R. there is allegation of kidnapping the minor daughter of the informant. F.I.R. is against unknown. Later on, during the investigation, name of the petitioner transpires.

Submission of the learned counsel for the petitioner is that victim girl was recovered and her statement was recorded under Section 164 Cr.P.C., which is annexed with this petition showing her age at about 17 years and she has stated that she has gone with the petitioner on her own sweet will, as she wanted to marry him.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Rohtas, at Sasaram, in connection with Baghaila P. S. Case No. 22 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure on condition that he has to co-operate in the investigation and appear as and when required by the police.
