JUSTICE NANI TAGIA ORAL JUDGMENT Date : 08-04-2024 The petitioner, who retired on 31.01.2023 from the post of Block Development Officer, Madhuban, East Champaran, Motihari, has filed this writ petition seeking a direction to the respondent authorities to grant the retiral benefits viz. monthly pension and part of G.P.F.
2. It has been submitted by the learned counsel for the petitioner that the monthly pension has already been paid to the
Patna High Court CWJC No.16699 of 2023 dt.08-04-2024 2/3 petitioner and what remains to be paid by the respondent authorities is the part amount of G.P.F. of the petitioner.
3. Counter affidavit by the Respondent Nos.2, 3, 5 and 6 has been filed, wherein, in paragraph 8 it has been stated as under :
"8. That it is humbly submitted that details of deduction of GPF has been sent to the District Provident Fund Officer, East Champaran vide letter no. 19 dated 09.01.2024. Authority for part payments of GPF has been issued by the District Provident Officer, East Champaran. Accordingly, payments of Rs.69,598/- and Rs.89,989/- have been made to the petitioner. Correspondence details of deduction made during her posting at Chapra has been made vide letter no. 06 dated 16.02.2024 for payment of rest of the due. As soon as the details are made available the same shall be paid forth with."
4. From the above, it appears that sum of Rs.69,598/- and Rs.89,989/- have been paid to the petitioner as a part payment of G.P.F. So far the remaining amount of G.P.F. is concerned, the District Provident Fund Officer, East Champaran by his letter No.06 dated 16.02.2024 has made a correspondence with the Deputy Development Commissioner, Saran at Chapra and the respondents state that as soon as the details of deduction made is received by the respondent authorities from the Deputy
Patna High Court CWJC No.16699 of 2023 dt.08-04-2024 3/3 Development Commissioner, Saran at Chapra in response to letter No.06 dated 16.02.2024 by the District Provident Fund Officer, East Champaran, the remaining G.P.F. amount of the petitioner shall be paid to him.

In view of the aforesaid averments made by the Respondent Nos.2, 3, 5 and 6 in the counter affidavit filed as above, Mr. Vishal Agrawal, learned counsel for the petitioner submits that this writ petition may be disposed of with a direction to the respondent authorities to pay to the petitioner the remaining amount of G.P.F. in terms of reply received from the Deputy Development Commissioner, Saran at Chapra in response to letter No.06 dated 16.02.2024 by the District Provident Fund Officer, East Champaran.
6. Prayer is allowed.
