2. The petitioners seeks bail in connection with Warisaliganj P.S. Case No. 400 of 2025 registered for the offence under Sections 319(2), 318(4), 338, 336(3), 340(2), 61(2), 111(4), 3(5) of the BNS and Section 66(B), 66(D) IT Act.
3. The petitioner are named in the F.I.R. and they are in custody since 01.08.2025.
4. As per FIR, petitioners found involved in cyber fraud alongwith other co-accused persons, where during raid some objectionable material were recovered. As per FIR, data

5. Learned counsel appearing on behalf of the petitioners submitted that no mobile or any electronic instrument appears to be recovered from the possession of this petitioner which may connect him prima-facie with present crime in question. It is submitted that recovered datasheet no where connect this petitioner with crime in issue. While concluding the argument, it is submitted that petitioner no. 1 is found involved in one more criminal case and petitioner no. 2 is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP, opposed the prayer of bail.
7. In view of aforesaid factual submissions and by taking note of fact as implications of this petitioner primafacie appears without recovery of any electronic items or without any electronic trails, coupled with fact that investigation of this case already completed where petitioners

No.74418 of 2025(2) dt.07-11-2025 3/3 remains in custody since 01.08.2025, accordingly, both above named petitioners, are directed to be released on bail in connection with Warisaliganj P.S. Case No. 400 of 2025 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Nawada /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
