The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 354(a), 379 and 504 of the Indian Penal Code.

The prosecution case in short is that the accused persons variously armed assaulted the husband of the informant due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.8.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. The petitioner along with other co-accused are said to have assaulted the victim.

Patna High Court CR. MISC. No.68994 of 2019(2) dt.04-11-2019 2/2 From the injury report, it is apparent that there are two injuries. Both the parties are agnates. There is a property dispute between the parties. For the said reason, a false case has been instituted against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 39/2018.
