2. The petitioner seeks bail in a case registered for offence under Sections 302, 120B, 34 of the Indian Penal Code and Sections 25(1-B)a, 26, 27, 35 of the Arms Act.

3. As per F.I.R., nephew of the informant was killed by petitioner and other co-accused persons by firing.

4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and in his further statement, he has changed the prosecution version and stated that the deceased was taken away by the accused persons including petitioner and subsequently, his (informant's nephew) dead-body was found. Similarly situated co-accused Bittu

Patna High Court CR. MISC. No.74928 of 2025(2) dt.04-11-2025 2/2 Kumar has already been granted bail by a coordinate Bench of this Court, vide order dated 20.11.2024 passed in Cr.Misc. No. 64966 of 2024. Petitioner is in custody since 29.04.2025.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - 17th, Muzaffarpur / concerned Court in connection with Sessions Trial No. 791 of 2024, arising out of Paroo (Paru) P.S. Case No. 33 of 2024.
