The petitioner seeks regular bail in connection with Amarpur P.S.Case No.423 of 2009 dated 4.9.2019 registered for offences punishable under Sections 341 and 323 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the petitioner in inebriated condition assaulted the father-in-law of the informant as well as the informant.

Submission of the learned counsel for the petitioner is that except the Bihar Prohibition and Excise Act, all the other Sections are bailable and he is in custody for about four months. Charge sheet has already been submitted.

Patna High Court CR. MISC. No.74563 of 2019(2) dt.13-01-2020 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 2nd, Banka in connection with Amarpur P.S.Cae nO.423 of 2019 dated 4.9.2019.

With the above direction, this application is allowed.
