1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Janta Bazar P.S. Case no. 147 of 2020, registered under sections 304B, 201 and 34 of Indian Penal Code.

3. As per the prosecution case, the informant states that he married his daughter to one Ashok Mahto. Soon after the marriage, the accused persons started to abuse and assault her for non-fulfillment of demand of dowry to the tune of Rs. 50,000 in cash. It is further stated that the eight named accused persons including the petitioner herein killed his daughter and made the body to disappear.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He is not a family member of the husband of the deceased and has no concern with their family affairs. The allegations are general and omnibus in nature. As per instructions received, the father-inlaw of the deceased has been acquitted vide judgment dated 5.12.2024 passed in Sessions Trial no. 699 of 2022 by the learned Additional District and Sessions Judge-XII, Saran at Chapra. The allegations being general and omnibus in nature and the petitioner not having any criminal antecedent, he undertakes to cooperate in the case.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R together with the material that has transpired in course of investigation, the petitioner not being a family member of the husband of the deceased and the allegations being general and omnibus in nature, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Janta Bazar P.S. Case no. 147 of 2020 on

No.80567 of 2024(3) dt.10-01-2025 3/3 furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra on the following conditions :- (I) The petitioner shall remain properly represented in the learned trial Court on each date of the case/trial and shall cooperate in the trial.

(II) In case the learned trial Court is of the opinion that the case/trial is being delayed due to non-cooperation of the part of the petitioner, the learned trial Court may cancel the bail bond of the petitioner and take him into custody till conclusion of the trial.
