JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2018 The petitioners are apprehending their arrest in connection with Banka P.S. Case No. 278 of 2018, registered for offences punishable under Sections 379 and 411 of the Indian Penal Code and Section 4/40 B.M.M.C. Act and Section 6(4) and 8 (d) of B.M. (P.C.S.) 2003.

On the information of illegal mining of sand, the officers of Mines Department and the police raided the place, where several persons were apprehended and the apprehended persons disclosed the names of petitioners alleging to be involved in illegal mining of sand.

It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and they have no

Patna High Court Cr.Misc. No.48158 of 2018 (2) dt.23-08-2018 2/2 criminal antecedent and their names have surfaced in this case on the basis of confession of apprehended persons and except that there is nothing against the petitioners.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Banka, in connection with Banka P.S. Case No. 278 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
