JUSTICE SHAILENDRA SINGH ORAL ORDER 07-02-2025 Heard Mr. Jitendra Kumar Bharti, learned counsel for the petitioner, Mr. Ramchandra Jha, learned counsel for the informant and Mr. Suresh Pd. Singh, learned APP for the State.
2. Petitioner seeks regular bail in connection with Madhepur P.S. Case No. 39 of 2024, dated 06.04.2024 registered for the offences punishable under Sections 341, 147, 148, 323, 324, 325 and 307 of the Indian Penal Code.
3. The main submissions advanced by learned counsel for the petitioner are that the FIR has been registered against 14 persons including the petitioner though the name of this petitioner finds place in the FIR but against him, there is no specific allegation and his name is at Sl. No. 4 and the main allegation as to inflicting farsa blow at the head of the informant
Patna High Court CR. MISC. No.81124 of 2024(4) dt.07-02-2025 2/3 is against co-accused, Pintu Yadav and Manish Yadav and the case of this petitioner stands on better footing with co-accused, Manikant Yadav @ Manish Yadav, who has been granted the relief of anticipatory bail by this Bench vide order dated 11.12.2024 passed in Cr. Misc. No. 83600 of 2024. It is further submitted that though on the body of the nephew of the informant who is said to be sole injured, five injuries were found but none of them was specifically attributed to this petitioner and only one injury found at right hand's middle finger has been opined to be grievous in nature. It is further submitted that the petitioner has been languishing in jail since 07.08.2024 and against him, the investigation has been completed, though, against him, there are criminal antecedents of six cases but all these cases have been lodged by the informant and his family members, and, he is on bail in all the said cases.
4. Learned APP for the State as well as learned counsel for the informant has opposed the prayer for bail of the petitioner.
5. Considering the aforesaid submissions advanced by petitioner's counsel and mainly taking into account the completion of investigation against this petitioner and the role
Patna High Court CR. MISC. No.81124 of 2024(4) dt.07-02-2025 3/3 of the petitioner in the alleged crime, this Court is inclined to accept the prayer for bail of the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Madhepur P.S. Case No. 39 of 2024.
