JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in connection with Kotwali (Jogsar) P.S. Case No.305 of 2019, registered for the offence under Sections 406, 420, 467, 468, 120(B), 471 of the Indian Penal Code.

Accusation is that accused Anmol Kumar, Prem Mishra @ Billo, Arun Jha and the petitioner Sunil Yadav, after hatching a conspiracy, got a sale deed executed from mental disordered elder brother of the informant, namely, Bilash Kumar Mishra with respect to his ancestral property on the pretext of false assurance of marriage of his elder brother with one

Learned counsel for the petitioner submits that in fact, the alleged sale deed was executed in favour of co-accused Anmol Kumar and the petitioner is not beneficiary of the said land and he has no concerned with the said sale deed but due to ulterior motive, the petitioner has falsely been made accused and he is in custody since 06.08.2019.

Having considered the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali( Jogsar)P.s. Case No.305 of 2019.
