JUSTICE SANJAY PRIYA ORAL ORDER 2/ 25-09-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Simri P.S. Case No.101 of 2018 instituted for the offence under Section(s) 302 and other allied Sections of Indian Penal Code.

As per written report, there is specific allegation against Sunil Pandey of causing fire arm injury with rife to the nephew of the informant, who sustained injury on his neck and died at the spot. Allegation against Bishnu Rai is of opening fire at Yogesh Kumar Thakur, who sustained injury in his arm. There is general and omnibus allegation against the petitioner, who is in custody since 23.06.2018.

Patna High Court Cr.Misc. No.49022 of 2018 (2) dt.25-09-2018 2/2 granted bail by a co-ordinate Bench of this Court by order dated 20.07.2018 passed in Cr. Misc. No.42676 of 2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Buxar, in connection with Simri P.S. Case No.101 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
