By the present criminal writ application, the prayer in cancellation of sale deed has been made, which has been executed by fraudulent means.

Counsel for the State submits that for the cancellation of sale deed, there is an appropriate forum for filing a suit. This Court is of the view that the present criminal writ

Patna High Court CR. WJC No.83 of 2023(2) dt.17-04-2023 2/2 application is mis-directed for the cancellation of sale deed. The proper forum is to file a suit for cancellation of sale deed before the Civil Court of competent jurisdiction.

With this liberty, the present criminal writ application stands disposed off.
