Learned counsel for the petitioner submits that the petitioner has filed this writ application for a direction to the respondents concerned to grant benefits of the scale of Headmaster and second time bound promotion, alongwith the benefits of A.C.P./M.A.C.P. in view of the Government Resolution, as well as Bihar Nationalized Primary School Teachers Promotion Rules, 2011.

3. Learned counsel for the petitioner submits that the petitioner may be given liberty to file fresh representation before the District Programme Officer (Establishment), Nalanda for grant of benefits as stated herein above.

4. Mr. Jitendra Kumar Roy 1, learned SC-13 for the State also submits that the case may be disposed of with a direction to the respondent District Programme Officer (Establishment), Nalanda to consider and dispose of the representation filed by the petitioner.

5. Having heard learned counsel for the parties and taking into consideration the nature of dispute, the petitioner is granted liberty to file a detailed representation before the District Programme Officer (Establishment), Nalanda and if such a representation is filed by the petitioner, the same shall be disposed of by the District Programme Officer (Establishment), Nalanda within a period of three months from the date of receipt of the representation by the reasoned order.

6. With this direction, the present writ application is hereby disposed of.
