2. In this case, the petitioner is seeking regular bail in connection with Didarganj P.S. Case No. 243 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per allegation, total 400 liters of polythene country made liquor was recovered from three motorcycles.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from his conscious possession. Similarly situated co-accused person namely, Pintu Kumar, has been granted regular bail by this

Patna High Court CR. MISC. No.80453 of 2024(2) dt.14-02-2025 2/2 Court vide order dated 10.09.2024 passed in Cr. Misc. No. 63045 of 2024. The petitioner has one criminal antecedent. The petitioner is under custody since 02.10.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Patna City in connection with Didarganj P.S. Case No. 243 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
